Registration of Pharmacists Act 1951 and Regulations

Introduction

Registration of Pharmacists Act 1951 is an act relating the establishment of the Pharmacy Board and registration of pharmacists.



Pharmacy Board Malaysia

Pharmacy Board Malaysia is established in accordance with Section 3 of the act Registration of Pharmacists Act 1951, with membership consisting of

  • the Director General of Health ex officio;
  • the Director of Pharmaceutical Services ex officio;
  • 8 Registered Pharmacists in the public service, appointed by the Minister
  • 3 Registered Pharmacists from any higher educational institution offering a course or programme in pharmacy, appointed by the Minister;
  • 2 Registered Pharmacists NOT in the public service, appointed by the Minister; and
  • 3 Registered Pharmacists NOT in the public service, nominated by the association representing pharmacists in private practice, approved and appointed by the Minister

NOTE: The period of appointment of members, other than ex officio members, shall be 3 years, but such members shall be eligible for reappointment.



Registration of Pharmacists

Under Registration of Pharmacists Act 1951, there are 3 types of pharmacist registrations.

  • Provisional Registration
  • Full Registration
  • Temporary Registration



Provisional Registration

As stated in Section 6 of Registration of Pharmacists Act 1951, a person shall be entitled to provisional registration if he holds
  • Any of qualifications specified in the First Schedule
  • A qualification in pharmacy deemed suitable for registration by the Minister after consulting the Pharmacy Board - may subject to restrictions and conditions imposed by the Minister
In accordance to Section 6A of Registration of Pharmacists Act 1951, to apply for full registration under Section 6B, a provisionally registered pharmacist shall
  • Shall engage in employment as a pharmacist to the satisfaction of the Pharmacy Board for a period of NOT LESS THAN 1 YEAR in any of the premises listed in the Second Schedule.
  • The Pharmacy Board may extend for NOT MORE THAN 1 YEAR the period of employment of a provisionally registered person if the Pharmacy Board is not satisfied with the performance.
NOTE: The premises in the Second Schedule are categorized into public and private training premises:
  • Public training premises
    • Government hospital
    • Public institutions
    • Health Clinics
  • Private training premises
    • Non-manufacturing pharmaceutical industries
    • Manufacturing pharmaceutical industries
    • Community Pharmacy
    • Private Hospital
    • R&D Academia
    • Hospitals under the Ministry of Higher Education Malaysia
    • Hospitals under the Ministry of Defence Malaysia



Full Registration

According to Section 6B of Registration of Pharmacists Act 1951, a person is entitled to full registration if
  • He gained experience as required under Section 6A above (provisional registration training); or
  • He is exempted under Subsection 6A(7): Any person who holds
    • holds any pharmacy qualification specified in the First Schedule or deemed suitable for registration by the Minister after consulting Pharmacy Board, AND
    • has been registered by any registration body responsible for the registration of pharmacists recognized by the Pharmacy Board

As stated in Section 11C of Registration of Pharmacists Act 1951, every person who obtained full registration under Section 6B shall be liable to be served with a written notice requiring him to assume appointment as a pharmacist in such post in such public service and on such date (as specified in the notice). In layman term, this is what we called as 1-year compulsory service upon fully registered.

If one fails to comply with such notice,

  • He is liable on conviction to a fine not exceeding RM50,000.
  • The registration under Section 6B shall be deemed to be revoked.



Temporary Registration

As stated in Section 11A of Registration of Pharmacists Act 1951, Pharmacy Board may upon application in writing, temporarily register a person who is registered as a pharmacist outside Malaysia BUT subject to such conditions and restrictions as the Pharmacy Board deems fit to impose. The temporary registration may be cancelled by Pharmacy Board at any time.

The 114th Malaysia Pharmacy Board meeting has set new criteria for temporary registration with Pharmacy Board. To register and practice in Malaysia, Pharmacy Board only allows non-citizen pharmacists who meet the following criteria:

  • Married to a Malaysian citizen
and they need to meet the following three (3) conditions:



Annual Certificate

As stated in Section 16 of Registration of Pharmacists Act 1951, every registered pharmacists who wishes to be retained on the register to make application in the prescribed manner before the end of every year.

As stated in Regulation 12 of Registration of Pharmacists Regulations 2004, the annual fee payable for retention on the register shall be RM 50 for a fully registered pharmacist.

NOTE: Pharmacists in the public service are exempted from the payment of the annual fee.
