Poisons Board

Introduction

The Poisons Board is established in pursuant to the provisions under the Poisons Act 1952 and serves to advise the Minister of Health of the followings:

  • Classification of new chemicals as Poison
  • Reclassification of poison in the Poisons List
  • Removal of poison from the Poisons List
  • Amendment of the psychotropic substances list in the Third Schedule
  • Addition or deletion of article or preparation in the Second Schedule

The Poisons Board convenes twice a year, usually in the middle and the end of the year, to discuss and evaluate the above and other related matters.



Membership

As stated in Section 3 of Poisons Act 1952, the Poisons Board consists of:

  • The Director General of Health as Ex-officio
  • 12 members (appointed by Minister of Health)
    • 1 pharmacist holding office in the service of the government
    • 1 officer of the Department of Chemistry
    • 1 officer of the Department of Agriculture
    • 1 officer of the Veterinary Department holding office in the service of the government
    • 8 persons ordinarily resident in Malaysia and not in the service of any government in the federation
      • 1 by the Malaysian Medical Association
      • 1 by the Malaysian Medical Council established under the Medical Act 1971
      • 1 by the Malaysian International Chambers of Commerce and Industry
      • 1 by the Associated Chinese Chambers of Commerce and Industry of Malaysia
      • 1 by the Malay Chambers of Commerce
      • 1 by the Associated Indian Chambers of Commerce
      • 1 by the Malaysian Pharmacists Society
      • 1 by the Malaysian Rubber Producer's Council

Every member, other than the Ex-officio, shall hold office for a period of 3 years or shorter period as determined by the Health Minister from the date of appointment.

Also, during the incapacity through illness or during the absence from Malaysia, Health Minister may appoint a person similarly qualified to be a temporary member of the Board, except for the Ex-officio member of the board.



Proceedings of Board

As stated in Section 4, The Director General of Health shall be the Chairman of the Poisons Board and shall preside at all meetings which he attends.

  • In the absence of the Chairman, the members present shall elect one of their members to preside.

If upon any question the votes are equally divided, the Chairman or member presiding at any meeting shall have an original vote (i.e. a casting vote).

The Minister may, after consultation with the Board, appoint a Secretary to the Board who shall not be a member of the Board or have any right to vote at its meetings.
